thatsnotwait 4 days ago +214
He and Alito are noticably more conservative than the others, moreso when you consider that nominees weren't *quite* as partisan as they are now back when he was nominated. Plus it would be nice if we hadn't set a precedent that sexual abusers on the court were fine.
214
Yashema 4 days ago +86
Thomas was the start of the Heritage Foundation approved list of justices. There was going to be a staunch Conservative elected no matter what. Alito, Gorsuch, and Thomas are equally partisan.

George H.W. Bush's other Supreme Court appointee was David Souter, who became a reliable liberal vote.

That's why he was pressured to select Thomas. He was Republican revenge for Bush Sr failing to be partisan.

Actually, given this record, its likely *any* conservative *would* have been better, they probably would have left sooner, maybe even during a democratic president's term.

And, strangely enough, Joe Biden fucked her over bad. Horrible job as a chair, Republicans walked all over him and Anita and smeared her with bullshit, he had no balls at all, and he's the reason we have Clarence Thomas. Joe Biden's legacy is no discharge of student loans thru bankruptcy, Clarence Thomas, allowing Trump to get us here, and being an old demented fool.
132

So much more - not codifying abortion rights, not pursuing criminal charges against Trump, not balancing the Supreme Court. He wasn't a bad president per se, but I think his legacy will become more and more tarnished the further we get away from maga.

Democrats refuse to read the room. Obama won because there was strong desire for change. Bernie put up a legitimate challenge to Hillary because there was a desire for change. Trump in 2016 won because there was a desire for change. Then Biden wins in 2016 and Dems assumed everyone wanted normalcy, when reality we wanted to end the lunacy. So when the status quo resumed Trump was able to win again because there was a strong desire for change. And reminder to all, don't throw your hands up in the air and give up because both sides are the same. Get involved in local, grassroots movements. Support candidates you want through primaries. And keep in mind it can take several election cycles for your preferred candidates to get elected so keep supporting them between elections.
85
fondledbydolphins 4 days ago +33
They're not refusing to read the room. They're getting paid to do nothing. Don't blame people for listening to the "loudest" incentive - that's what humans do. If voters were actually losing their minds it would speak louder than those donations.

I think Biden is kinda Rutherford B Hayes v2.0. I toured Hayes' house last year and was surprised to see so many similarities between him and Biden. Hayes presidency was marked by Reconstruction and ever increasing oligarchy in the nation. Based on his private diary entries and letters, Hayes genuinely believed in trying to make black lives better in the south and trying to rid DC of oligarchs' influence in politics. However with both house of congress and the Supreme Court against him he was a pretty ineffective president overall. In Biden's farewell address he warned that the oligarchy was taking over America; which it's clear he often ran into problems with. I think Biden, like Hayes, was a well meaning president who may have been a good president if he were elected into a more favorable situation.

And here is a nice little addendum on how f****** petty he was: Once he got into the seat, he sat there silent…..FOR TEN YEARS. No comments on cases uttered into record, no questions, nothing. Yes he has every right to do that. But here is the thing: Pages working under him told of asking him about it and he pretty much admitted that he was not doing shit as ‘revenge’ for the hearings. Also admitted that he would take every opportunity to sink any Democratic led case for it as well. Yea rumors and all that but have you seen his record? The joke on him is he is looking for a way to argue back black people to 3/5’s a vote if Republicans allow it. Who knows if that is a joke nowadays judging by what’s going on.

Thirty-four years. No one should hold a position of such power for so long, whether you like Thomas as a justice or not. While I agree that their terms should be long enough to insulate them from planning their next move, as it were, life is too long. Make it 18 years, staggered such that a new justice is appointed every other year. Each House gets one, each President two, and each Senate three.

He has to have the ego of all egos. He got embarrassed a little while being given one of the best jobs in the world for life. Any normal person would take that W and move on. He decided to become a prick of historical proportions. Didn't say anything in hearings for like 10 years. Intentionally rules against anything that might benefit his own race. Married a fat b**** who tried a coup. Endlessly funnels money into his own pocket and when caught just keeps right on doing it. I think it was less than a month ago he gave a shoutout to the big donor who has lined his pockets at some speech he was giving. Has probably never experienced a moment of actual joy in over 3 decades. Will die and be forgotten.

The theoretical moment the Dems win the election, if the Senate is still majority MAGA, there is a 100% chance Thomas and Alito are retiring and forcing in 2 new Trump appointees. The supermajority absolutely has to be broken through votes in a few months or we're all extra fucked. And this week's primaries in a few states aren't all roses for indicators of that happening.
103
C_Coolidge 4 days ago +28
What's to stop them from doing the same thing if they do lose their super majority this year? Couldn't they just resign this year and appoint new judges before the Republicans leave office?
28
Podo13 4 days ago +19
Oh I think that's definitely on the table. They just have to hope that every seat lost will stay loyal and not pull a McCain by finally doing what's right by blocking the candidates before their seats officially swap in January. But this midterm is extra important because it has the largest disparity between Dem(13)/Rep(22) seats of the cycle. There's more seats to possibly lose and that means the more unknowns when it comes to getting stuff through. Edit: Though I think projections are still for a fairly even senate at the moment. A lot of the seats up for grabs this round are from very red/blue states. There's only a couple that seem possible to flip.
19
Desecratr 4 days ago +18
I think you're underestimating the egos of Justices. You do not make it to that bench without being completely full of yourself. I'm not sure they can help themselves and will end up not retiring, regardless of who wins. Especially Thomas. Two more years and he goes down in history books as the longest serving Justice. You think he'd give that up for the good of the conservative movement? I doubt it. This all assumes elections aren't just canceled.
18
Podo13 4 days ago +21
That is also true. RBG fucked the country quite a bit by not retiring a decade earlier.

3
BoleroMuyPicante 3 days ago +3
It's extraordinarily unlikely Dems take the Senate in November, but if they somehow do you can bet Alito and Thomas will both resign the day after the election so their replacements can be confirmed before control of the Senate changes on January 3rd.

Something like 20 years feels reasonable. It's long enough that their career should be basically over by then, especially given their average appointment age. So even if they try to leverage their role for post-position gains, they're only likely to be able to take advantage of it for a few years. There's also an option where they're forced to retire at the age of average life expectancy in the US or something, so no matter when they're appointed, they can't stay past 78 or so. Combine the two and you'd have a pretty safe way to avoid ancient SC justices holding their seats well into their 80s or 90s.
90
blaqsupaman 4 days ago +14
I feel like there still needs to be some amount of unpredictability to it so they can't strategically plan their retirements on who's in office at the time.

The House has no say on SCOTUS appointments. Only the Senate and President. Which is why it will always lean conservative. Every state gets 2 Senators, regardless of population. So it's extremely difficult for Dems to get a meaningful majority in the Senate.

KingFebirtha 3 days ago +12
Here's a fact: Over 30 years ago, when Thomas was confirmed, we had a different concept of red vs blue states and the political demographics of each state. In the 1990 midterms, democrats won senate seats in Alabama, Tennessee, Georgia, Louisiana, Arkansas, Oklahoma, Iowa, and Nebraska. Also, we had 100 million less people. It is a completely different ballgame today, and yes, the senate has a fundamental conservative advantage like the OP said. And unless things drastically change, it will remain that way for the foreseeable future.

In all seriousness, we should be happy for that. Him retiring opens up a spot to put in a better justice. Right now, that would allow Trump to get another Gorsuch or Kavanaugh. But since Thomas is so self-serving, him sticking around opens a chance for Democrats to replace him.

Every public office. It's not ageism when there are already minimums to run for offices. It should be something like 2 terms for president (8 years. 10 under special circumstances). 2 terms for senator (12 years) and 5 terms for congressperson (10 years). As for SCOTUS they are voted in however I would say upon age 70(?) they will need to step down. No term limits here
91
Reylun 4 days ago +12

12
shellexyz 4 days ago +15
Presidential limit is already 8, 10 under special circumstances. (VP ascending just over 2y into the term, then two successful campaigns. I’m not clear how things would go if you ascended to the presidency twice and attempted to run for the big seat too. President Alice dies just over 2y into office, VP Bob ascends. Gets elected on his own the next election. Bob decides not to run (or loses) the next one, but is elected/named VP in the future. Again, rises to the presidency just over two years into office. Can Bob run on his own again?
15
brutinator 4 days ago +3
> It's not ageism when there are already minimums to run for offices. Unfortunately ageism, as defined in the legislature, applies to discrimination against people 40 or older. The only justifications for age-based retirement is when there is a measurable safety risk directly attributable to age (like pilots or the military). Forced retirements in all other cases is against the law..... Is what I thought before I looked up the ADEA, and it SPECIFICALLY has a carveout for forced retirement of executives over the age of 65 in high policy-making positions being completely legal, which I think easily fits the majority of goverment.

That's also the "correct" answer per civics class. It was intended to protect the court from being too heavily influenced by politics, right? Essentially preventing "vote to allow this and I'll make sure you get reelected" or "if you don't do X, we'll make sure you never serve after this term" We REALLY should've had a way to recall justices as citizens

Clarence Thomas is the ultimate DEI hire. Literally got the position because they wanted a black conservative justice to replace Thurgood Marshall and he was the only one available. He's one of the most disgraceful justices to ever serve and replaced one of the best Supreme Court justices of all time.
