He is rumored to be retiring at the end of the term. No doubt he wants Trump to replace him, and there is no guarantee of holding the Senate next year. But an even bigger hint: he has a book coming out in October. That is when the next term starts and he wouldn’t be available for the customary book tour a justice would do (hence most sitting justices see their books come out in the summer). That means he may planning to be on the bench in October.

The blatant hypocrisy means that now judges will almost ALWAYS retire in order to get replacements in line with their ideology rather than trust fate and serve for life. And it’s precisely for that reason that we need to institute judicial term limits.

Pass amendment with constraints on USSC nominations and counts 4. Pass law saying amendments need 2/3 majority vote again 5. If you mean constitutional amendments you obviously don’t know what you’re talking about. The amendment process is outlined **in the constitution**. It is **not a matter of law**, and requires a 2/3 majority of *both the house and senate* to apply. You cannot pass an amendment with simple majority no matter how many **laws** or **conventions** you change. Therefore you cannot change the requirements to pass amendments unless you already meet the requirements for passing an amendment itself.

While that is a fair question, we are in this weird situation where Congress has stopped doing most of its job. The filibuster would be a thing to protect, if what it protected was leverage over the job being done. Which mostly isn't being done. So I think it is a time that what is being defended is the idea of the filibuster, and a past when Congress ensured its own relevance in governance. We need that time back, but the path from here to there is not a straight line. It may not be possible to preserve specifics without first ensuring a foundation exists at all. Will there be a consequence? Yes. And somehow that risk would need to be part of the planning for fixing this ungodly mess we are in.

The US constitution doesn't actually say how many judges the Supreme Court is supposed to have. It's basically only 9 out of tradition. Any president can just nominate more justices, and if the Senate confirms them, they're in. FDR kept winning majorities along with his 4 election wins, so he would have had the votes to confirm whoever he'd nominate.

Alito is gonna retire way before then. Im surprised he didnt go last year. His wife said on camera in late '24 that they couldnt wait to get out of DC if Trump won(because they were tired of it, especially the wife, and Alito needs repub president to pick his replacement).  Thomas is probably gonna retire too. Conservatives have been way better about timing retirements and things for judge seats. Neither one of them will make Ginsburgs mistake.

I would be 100% shocked to see Dems led by Schumer, do anything but cave. If Schumer gets replaced, the new leader will at least fight a little. But i dont know if any potential dem leader will just say no new judge for 1-2 years. Supposedly Schumers chosen successor is Schatz, who i do not think would fight enough
