A federal judge ordered the University of Pennsylvania Tuesday to hand over lists of Jews on campus to the Trump administration to aid an alleged investigation into antisemitism.

Fishing expeditions are apparently sufficient grounds for a search warrant? Also - why on Earth does anyone have "lists of Jews" in the first place? I'm beginning to think all of this data collection isn't a great idea after all.

Oh it's blatantly unconstitutional but many of our courts were stacked with conservative loyalists that hate the US.

Could you walk me through how our traditionally expansive discovery rules meet the free association and exercise issues? I’m just not familiar, but a lawsuit asking for Rogs saying “have you ever been a Nazi party member” and other classic association questions is, to my knowledge, pretty normal. And in a discrimination case, “please identify how many of your employees are (insert religion) seems fine, assuming it’s related to allegations (so imagine a case where an employer is alleged to never hire and indeed fire any Muslim employees).  I can see some big overbreadth issues here, and I see a Wiwa problem, but that’s more of a fishing expedition problem than a 1st amendment issue. And while fishing is a constitutional problem, it’s one endemic to almost every lawsuit ever filed in the US.

But this case it's wildly in the other direction. It's like if Hitler himself used his authoritarian power as a shield to protect jewish people. "I need zee list of ze Jews. We need to tackle ze widespread antisemitism on ze campus and dis requires ze utmost cooperation by ze jews in order to expel and detain ze Pro-Palestine protestors!"

I never said they were being altruistic. They're still monsters, and it's still wildly racist. It's...lol...white hat racism. It's being a good racist to one group so they can be bad racist to the other.

This request sounds highly sinister and should not be heeded. It sounds exactly like the kind of request the incoming Hitler regime would have made to universities, back in 1933/4.

They don't. They're being asked to create a list of Jews. Quote from their statement: > requiring Penn to create lists of Jewish faculty and staff, and to provide personal contact information, raises serious privacy and First Amendment concerns. The University does not maintain employee lists by religion

We kinda hate being on those lists, so I don't think there will be too many volunteers. Will this administration get the list of employees from the IRS and send it over to the FBI or DOJ so that some interns can sift through social media looking for words like Hanukkah, Seder, Mazel Tov, etc? Probably.
