To put that into perspective: Urinating in public in Idaho can result in up to 90 days to 6 months in county jail, depending on the local ordinance. First Offense vs. Subsequent Offenses: Some jurisdictions, like Fairfield, classify a first offense as an infraction ($100 fine) and subsequent offenses as misdemeanors (up to 6 months jail and $1,000 fine). You are safer to piss in public than to simply be Trans and walk into the bathroom.

It’s a stupid bill designed to make Democrats look out of touch for opposing it because it is so easy to demagogue. “Democrats want to let men use the same bathroom as little girls!”. I despair for this country.

I see your point. Then write a bill that would restrict fundamentalist Christians from using any restroom that a child might be in. I don’t think that would advance the electoral prospects of Democrats though. As an atheist I am in the unpopular minority too.

I am not the author of this op-ed. Nikson Mathews, who spoke up this week in the Idaho state legislature against this bill, is the author. He's an excellent person to get to know. He is a strong advocate in Idaho for trans people. I am only posting his words to get people to understand the devastating impact these hateful bills in Idaho will do to everyone in the Gem State. >There is something surreal about standing in front of a legislative committee and asking them not to pass a bill that would put you and your community at extreme risk, while also criminalizing you for trying to avoid that risk. >Right now, Idaho lawmakers are considering House Bill 752, the harshest bathroom bill introduced in the country. It criminalizes trans people simply for being present in a bathroom or facility that aligns with their gender identity. It does not require harm, only presence. If passed, a trans person could walk into the bathroom to wash their hands and face up to a year in jail. If they did it again, the penalty would increase to up to five years in prison. >During the House floor debate, one representative said that if he ever saw a person he perceived to be a man walk into the women’s facilities while his daughters were inside, he wouldn’t wait for the police to arrive. The implication was clear: He would take matters into his own hands. >Despite being opposed by multiple law enforcement agencies, this bill is being sold as necessary to protect women and girls. In reality, it does the opposite. During Senate testimony, one Idaho cisgender woman shared multiple instances in which she was denied entry or physically removed from a restroom because she didn’t fit someone else’s personal expectation of how a woman should look. >Nothing makes the hypocrisy of this bill clearer than its author, Scott Herndon, a former state senator from Sagle. In the same newsletter where he claims to champion the safety of women and girls, he is promoting a gun giveaway. Notably, guns are the second-leading cause of death among children and teens in Idaho and account for 88% of intimate partner homicides of women in Idaho. >And despite all of this, the way HB 752 has moved through the Statehouse does not reflect the gravity of its consequences or the level of opposition from Idahoans. >I am angry for my trans community, who just want to live our lives and be recognized as full and deserving human beings. I am angry that lawmakers are using their power to target trans and queer people, our immigrant community members and people with disabilities instead of addressing the real challenges facing Idaho families. And I am angry that I am forced to spend my time fighting for the basic right to exist safely in public spaces. >HB 752 is not about safety. Idaho already has numerous laws that protect the privacy, safety and dignity of its residents. This bill makes these spaces more dangerous for everyone.

I've seen plenty of 100% cis people mess up and get into the wrong bathroom due to being drunk, sleepy, or just looking into their phone. At least in Europe usually you just apologise and walk out feeling dumb, nobody calls the police.

That is the thing with most if not all of bills of this type. It often has the effect of gender policing, effectively becoming a witch hunt for people who are gender nonconforming on the basis that they thought they were trans.

Or a dad who's taking care of his children but the men's bathroom doesn't have a changing table so he has to use the one in the women's bathroom (which is highlighting another gendered problem we have...).

As with so much of this sort of legislation, it's nearly impossible to actually enforce which means it'll be used to intimidate & serve as a punitive multiplier for other "offenses". The actual enforcement will be erratic & unpredictable & entirely focus on harming trans folk rather than addressing any actual public safety issues.

They are also using these cultural war bills as filler. It makes it look like they are doing something while the population and the media is fully distracted from the actual problems that they have no intention of actually solving. Stupid voters think "men in women's sports" is a bigger problem than millions of people not being able to afford basic healthcare. It's textbook politics. This tactic goes back to ancient times. And unfortunately, it's just as effective today.

Does that means in Idaho, every establishment must hire both male and female janitorial/custodial staff because going to inside the bathroom of the opposite gender to clean is illegal? LOL that would be dumb.

I've lived in Washington and Idaho, in Washington at my previous job employees cleaned all bathrooms regardless of gender. In Idaho only female employees are allowed to clean the womens restroom and only male employees are allowed to clean the mens. And if the department primarily responsible for cleaning them doesn't have an employee of the "correct" gender scheduled they'll just pull a woman/man from a different random department to clean it instead. This is one of the most backwards and conservative states in the US it almost feels like being in a different country.

Imagine 1/2 of America hates/afraid??? transgender children, while their little boy or girl is being raped/groomed by the pastor! LGBTQ community put $1,000,000,000 in an account with only one person who can access and on 1/5/27 you will have your billion, more support than ever for the LGBTQ Community and finally the LIGHT will be shined on the true predators and the horrors of the church will start to end! The fact that people can be so easily terrified of a perceived danger, like trans people, and easily distracted from real dangers, like the one big beautiful billionaire’s bill, is astounding to me. Anyone creeping in a bathroom is already illegal. Targeting trans people isnt stopping a loophole. Men can already just walk into a women's restroom, and they'll continue to be able to do so after this law. This is designed to hurt trans people, not to protect children. Trans women don't deserve punishment because of what some other people might do.
