And if the ICC wants to be impartial (which is very important for a court to be legitimate) it has to consider all cases of warcrimes, not just the cases you or I want it to hear.

The ICC doesn’t hear all cases of the 4 core crimes under its jurisdiction. There are jurisdictional and gravity restrictions as well as the fact that it’s a court of last resort

It's not about not acknowledging it's about being a signatory. Spain volunteers to give jurisdiction to the ICC therefore they can be held responsible by the court if the court hears the case and agrees that they are violating the law. Israel however is not a signatory onto the ICC they did not volunteer to be subjected to it. Additionally, only states can be a signatory and give the court jurisdiction. Palestine is not a state in most criteria. (Territory. Government. Permanent population. International relations.) Israel argued that they can't be forced into the ICC's jurisdiction by a non-state that cannot be a signatory. Gaza being ruled by Hamas is even more problematic since the PA is claiming jurisdiction over territory they don't control to refer the court to a country that hasn't signed on to the court. Lastly, Israel has repeatedly brought up the prosecutor's conduct as ranging from against protocol to entirely biased.

An Israeli advocacy group said Tuesday that it had asked the International Criminal Court to consider legal action against Spanish Prime Minister Pedro Sanchez for allegedly “aiding war crimes” through exports to Iran. The complaint comes in the midst of an escalating diplomatic spat between the two nations, which began with the start of the Gaza war in October 2023 and worsened after Madrid recognized a Palestinian state a year later. Filed by the Shurat HaDin NGO, which has taken legal action worldwide against what it calls “Israel’s enemies,” the lawsuit accuses Spain of providing “components required by the regime in Tehran and its proxies for military purposes.” In a filing submitted under Article 15 of the Rome Statute, it alleges that Spain approved the export of about 1.3 million euros’ worth of so-called dual-use products that could be used in detonators and other explosive-related applications. “These materials are not innocent industrial products, but critical components that enable explosive devices to function, and they were transferred in circumstances where their use for attacks against civilians was foreseeable and reasonable,”

And the request is coming from an organization based in, and advocating for, a nation that not only refuses to recognize the ICC, but which also is led by someone for whom the ICC has issued an arrest warrant. You CANNOT make this stuff up.

If you read the article you'd have seen that the group filing the complaint is an NGO, as in non-governmental, as in they have nothing to do with Netanyahu or Gallant. Multiple people can have committed multiple war crimes independently and simultaneously.

Lmao they must be running low on their anti-semitism deflective shields to do something as nonsensical as that In response, Spain should simply declare, and attempt to encourage the EU to declare, the IDF as a terrorist organization akin to the IRGC and file a complaint against all members of the IDF before the ICC. Since most Israeli adults (including the members of this Israeli "advocacy" group) have served or are still serving in the IDF, it would be nice to put most of the Israeli population on trial for all the war crimes they committed and are committing 👌

How strong do you think that evidence would need to be for it to be an ICC issue? We know who's been directly selling the weapons that are being used in Sudan, Yemen, Azerbaijan, Myanmar, etc.. No one's getting prosecuted. Those aren't even dual use. The ICC never weighs in on the legality of arms dealing.
