they seem to be under the misguided impression the justice system is in fact designed for justice.. survivors forced to play whistleblower at the expense of their safety and peace for the rest of thier life... so the public can have a cozy feel good ending and move on? not how any of this works. i would also take the money a thousand times over. and for the thousandth time, the rapists actions are not the survivors resposnsibility.

When the justice system is going to only give them a couple years for what they did to you, and then they'll be out to hurt someone else, on good behaviour, the choice is harder to make between money and jail time. I believe if they served reasonable sentences for the harm they caused, money would not be the option people choose to pursue for justice. The money can help pay for therapy and relocation, if you get enough. That can at least ensure your own temporary safety and some recovery after a traumatic experience.
I understand the argument that people are looking for money, but if the person who happened to harm you is rich enough and behaved well enough to get out of jail quickly, or you feel the system is rigged against you in another way, justice is better served making them pay you so you, yourself, can disappear and find peace away from their reach. A lot of victims don't want to go through the stress and re-traumatize themselves in court proceedings. It is easier on them, emotionally and mentally, if they don't have to go through the trouble.
Some people just don't feel up to pushing that hard for the result they are not likely to get, and would rather take whatever they can and go.

The US tends to function on a punitive model, which creates career criminals through incarnation as the primary function of justice. This is a stark contrast to Nordic models that seek to restore all parties involved towards a net benefit for society.

This is a civil case, and for civil cases in England and Wales, if a claimant rejects a settlement which is more then they get awarded at the trial, they can end up not being able to recover the legal costs (i.e. you are incentivized to settle if a reasonable offer is made).
