Funny story. Lindsey previously got a military court to rule it was acceptable for him to serve in the military while a sitting member of congress. So he won't be able to argue he can't serve while being a senator.

Funny enough, Don’t Ask, Don’t Tell would probably protect him. Graham remains nestled in the closet, and under the DADT standard, as long as he didn’t make his status public, the military couldn’t seek out any information related to it. On the other hand, the military prior to DADT could absolutely investigate whether he was gay, and I’m sure there would be some interesting evidence.

And since he's retired from the Navy, he doesn't have to be drafted but just recalled to duty... But as he was a JAG officer I am not sure we really want him around to give legal advice.
