Poole has undergone multiple surgeries on his brain. Turner is charged with misdemeanor aggravated assault. How is this not a felony?

Because crimes build on mens rea (intention/knowledge of wrongdoing). Turner didn't initiate the confrontation (Poole did) and the level of violence used was, allegedly, a single blow with a closed fist. The majority of damage was (again, allegedly) due to Poole striking the ground in an unfortunate way.

Eggshell Skull Precedent.  https://en.wikipedia.org/wiki/Eggshell_skull If you hit and kill someone while you didn’t expect to kill them but they died because you didn’t know they had x medical condition.  You can’t use your ignorance of their medical history as defense or mitigating  factors. N

Yes I'm a criminal defense attorney and former prosecutor. The mens rea is usually to commit the battery and the level of harm often determines the degree. In my state this would be a 3rd degree felony.
