Which is also why it would be insane for the neighbor to try and file a civil suit, since all Ritchson has to do is call up the cops and say he changed his mind and wants the reckless endangerment charges to go forward.

With what the neighbor did, he should be chargeable without a complaining witness or victim. The evidence we can plainly see is enough. While Alan could be a primary witness for a trial, the goal and great outcome would be a plea deal that involves said neighbor taking some sort of personal development classes and being on probation for at least a year. I don’t need to know their personal details and carry anger but not having a legal check after having done that is still a privilege.

Yeah, at first they pitched this story like he just punched his neighbor for no reason. Then it turns out Alan had body cam and you can see the guy basically walk out into the middle of the road to try and stop him on his bike and makes him crash, so he punches the guy (not great), but justified considering he's putting him and the kids in danger. Why you would f*** with a guy who's literally typecast as the hugest soldier in any room is beyond me.

If someone intentionally gets in your way, causing you to crash and then approaches you aggressively, I think it’s reasonable to punch first. You don’t have to wait until after they attack you to defend yourself. You also can’t provoke a fight and then call it self-defense.

Even in a stand your ground state (like Tennessee is) and you don’t have a duty to retreat before defending yourself, Reacher, I mean Ritchson, tried to leave but was blocked. That’s very justifiable for him to turn the encounter violent. Notice that Ritchson stops hitting the guy when he’s on the ground. If he did, then that would be assault unless you can convince a DA that he was still a danger.

Yes. The idea that someone “presses charges” isn’t really correct, it’s not up to you, but if you’re telling the cops you won’t cooperate if they do charge him then they sometimes won’t bother

"Pressing charges" is, as far as I know(IANAL) one of those bullshit legalese terms that doesn't really have meaning in the American justice system, but pervades public thought on it. You, as a victim, do not get to decide whether or not the state brings charges against someone. That is *entirely* the decision of the District Attorney's office. *However*, the DA will usually not get very far in a case if it doesn't have the victims willful assistance. So, a victim doesn't "decide" whether or not to press or drop charges, *but* if the victim doesn't want to pursue the case, the DA will almost always drop the charges because a case without a victim isn't a case. If your victim doesn't cooperate or show up to court, you usually aren't going to get very far. But the victim doesn't just get to tell the DA "I'm pressing charges!" The DA can absolutely just go "F*** no" and just...not file charges. So like, yes, you're right. The cops *could* get a warrant from a willing judge and arrest Ronnie, and the DA *could* file charges, but the case is super weak if Ritchson isn't willing to cooperate.

The way this first blew up on social media was just that edited video of the punches. Seeing the neighbor immediately playing the victim on TMZ (I think?) shortly after, and Alan not having responded yet, I already figured there was more to the story. Luckily, his POV footage completely cleared him. It's crazy to think his career could've ended right there if he didn't have that video.
