There are intelligence officer with official covers = diplomats who can’t be executed. They can only kick them out of the country. However intelligence officers without an official cover like tourist, actor, businessman etc. Then yes, they will jail them to trade them for one of their own.

It may surprise you to learn but diplomats are not actually all sent to spy and some of them might even in fact be useful in case the war ends and you need to negotiate an end to sanctions.
