It means the justices issued it without making it public which justice voted which way, and also didn’t write out a justification for their ruling. No hearings before the Court, either, they’re issuing a ruling without hearing any arguments. They’re only supposed to do shadow docket rulings like that on cases that are a pressing matter that warrant a rapid response, but the Roberts court abuses the hell out of the privilege.

Which strengthens the Supreme Court's own position because lower courts will inevitably have guess. This gives appeals a greater chance to move forward. Which in turn drives more and more cases to be decided by SCOTUS. Which leaves them a greater opportunity to write and rewrite case law as they please.

That is not what's being said here to be clear. Trump's DOJ is refusing to continue the prosecution against Bannon and is pushing for the charges to be dismissed. If the DOJ corruptly refuses to prosecute someone there isn't much that SCOTUS can do. This isn't saying that Congress can't hold people in contempt, it's saying that a corrupt DOJ can refuse to prosecute pretty much anything it doesn't want to.

It's not that simple. Congress could assert much more power, but has \*chosen\* not to. This is the key insight - that it chose to give up its own powers. The founders seemed to envision a congress that was "jealous of" and would "protect" its own powers. What the founders didn't seem to envision was a congressional majority that was \*far\* more concerned with showing loyalty to the president in order to be reelected, than to protect its own powers. Johnson isn't the first to do this, but it's so extreme under Johnson. Congress isn't concerned with protecting its own powers, it is concerned with showing loyalty to Trump in order to get endorsements and superpac money.

Because that's not what's happening here. Congress by statute farmed out contempt to the DOJ for convenience. The DOJ ALWAYS had the discretion to drop cases. If Bannon was held in ***inherent contempt*** the SCOTUS can't do anything about it. (See: Jurney v. MacCracken)

People are getting the wrong conclusions from this. The case isn't being decided on the merits of Bannon's argument and it's not setting any kind of precedent. It's being dismissed because it's on appeal and one of the sides (Trump's DOJ) is choosing to no longer pursue it. There's no case if the prosecutors don't want to prosecute, so SCOTUS is saying there's nothing to do and handed the decision to the side that's still bothering to justify itself.

tl;dr: DOJ under Biden led the prosecution of Bannon for contempt of Congress. He served 4 months. New DOJ under Trump wants to abandon / dismiss the case, but it can't do so without the court's permission. SCOTUS gave that permission and sent the final decision authority back to DC Circuit.
