John Oliver mentioned they are agreeing with Trump on shadow dockets 83% of the time. It was 53% with Biden and far, far fewer shadow dockets requests.

The irony that he provides evidence of a political leaning supreme court, and they recently said they are not without evidence. Just like them providing no supporting information on the shadow docket rulings. Folks, this supreme court IS political leaning.

honestly at this point, the Roberts Court might be as bad, if not worse than the Taney Court.

History is written by the victors, and unfortunately the worst people are winning. Dems are captured opposition, GOP is getting their wishlist, and the court is rubber stamping the downfall of American democracy.

That is incredibly unfair to perfectly fine vaginas everywhere. John Roberts is a fetid d*** with weeping herpes sores. And Sam Alito and Brett Kavanaugh are the pair of hairy, pendulous balls hanging behind him.
73
alficles 8 hr ago +31
Nah, Kavanaugh is slightly farther back. You know, where the beer goes in. It's still incredible to me that we have a Supreme Court Justice that can't tell the difference between "Bottoms Up!" and "Up Your Bottom!"
31
Taellosse 8 hr ago +14
I usually refer to him as "Justice 'I like beer' Kavanaugh". I want to say that I couldn't believe he was confirmed, but we had Clarence Thomas' example sitting right there for decades, proving just how low the bar really is. But you make a good point about the anatomical analogy. I guess Thomas is the other testicle, then. I *had* been thinking of him as the scrotum, but I can adapt.

It's playing with fire. If you disenfranchise people to the point that they know they will not be heard and they have no democratic recourse to change the system they will look to undemocratic means to change things. The way they are operating they're doing it with such utter contempt and impunity and they're moving so fast that they are all but begging mass protests, strikes and riots to explode. Especially during the summer. To paraphrase King here, riots are the voice of the unheard. This is going to get wild.

I feel like a lot of people are in a holding pattern until the midterms, since we haven't had a major election since this shitshow started people are still hoping that our civic systems will prevail. As the OP shows both parties are preparing for the midterms to be bloody and are going all-in on establishing whatever systemic advantages they can. Both parties see this as potentially the last election that will ever matter (for different reasons.) No matter what happens, I expect things to get *interesting* after.
59
Buzumab 6 hr ago +15
I don't know. I think community has been sufficiently degraded such that you can have disenfranchisement that doesn't lead to revolt. Decay of the social fabric and general dysfunction, definitely, but I really don't know if we have the capacity to meaningfully organize. The institutions that supported King aren't all weaker now, and less interwoven, with less unity in direction. Everyone is more isolated, and more people are almost totally isolated. Even major movements like BLM didn't really lead to major policy shifts except in a handful of localities, and it's arguable that the counter-reaction has made the situation worse in some ways.
15
NeutralBias 7 hr ago +16
The people making these decisions are old and do NOT care about the consequences. Their time horizon is the rest of their lives and everything after that is irrelevant. The country can burn down for all they care, so long as they get theirs on the way.

I’ve come all the way around on the idea of packing the court. If the Dems can get enough power to pull it off, let’s f****** ram four more justices in there, make it a bakers dozen and get shit done. DC statehood. Codify abortion rights and LGBTQ equality. Reverse Citizens United. Do it all.
196
Shadowislovable 8 hr ago +54
Reminder that there are 13 circuit courts but only 9 justices. 13 would make it so that there'd be a judge to handle every circuit, and the chief to handle the federal circuit.
54
Beginning_Ebb4220 8 hr ago +71
What happened under Trump cannot be allowed to continue to happen. I support stacking the court if they can, term limits and overwhelming reforms if they cannot.

It \*is\* racist, completely definitely racist, but the larger goal is to disenfranchise Democrats. Black people are still reliable votes for Democrats. I wonder what the right’s reaction would be if the Democrats tried to split up majority elderly or Christian districts.
89
Taellosse 9 hr ago +36
Well, *obviously* that would be ageist or a violation of the First Amendment, respectively! We can't have *that*! And if you think they're going to care that this is *obviously* hypocritical, I have this *amazing* bridge in Brooklyn I am looking to sell for *c*****!
36
Hysteria625 9 hr ago +23
So I suspect that a significant portion of the GOP is racist. What’s scarier is how many more of them are not technically racist, but more than willing to use rascism to win. It’s a subtle difference, and I’m sure many people would wonder what the difference is. Here’s the thing—you tell a GOPer that they’re racist and they’ll chew you out but good, because how dare you accuse them of it. But they’ve discovered what LBJ said so long ago, that if you convince a poor white man that he’s better than a poor black man, the poor white man will happily let you pick his pocket.
23
-Saucegurlllll 7 hr ago +19
White supremacy is like the air, they cannot see the thing they breathe in every day. It's so ingrained into society that even just trying to point it out can make you sound like a conspiricist. Like credit scores are white supremacist. They structurally disadvantage black people by baking into the number the systemic oppression from previous eras of red lining and other racist policies. But people hear that and go "How can a number be racist? That sounds dumb as f***." But that's WHY we analyze racism structurally. We analyze systems and their racist outcomes so that it doesn't matter what any individual does or feels. This supreme court has decided to hault such analysis. They individualize all racism. In order to prove a law is racist, you cannot look at its outcome, you can only look at what the legislators said when they wrote the law. And so, laws that attack racist systems are transmuted into racist laws, and discriminatory laws are transmuted into non-racist laws so long as the entire GOP voting for it doesn't say "And we're doing this because we hate black people." And even then John Roberts' "major questions doctrine" would pave the way for some bullshit.

Almost like there really was a party switch at some point in America, particularly when the aristocratic DixieCrats of the 1940’s-1960’s changed parties to the Republican Party during the Civil Rights Era, ultimately changing voting demographics and the political landscape in the process.

That's why black voters need to get out and vote in EVEN BIGGER numbers than ever before. They're trying to steal the black vote. Don't let them.
35
jpiro 9 hr ago +37
This. And it’s important to keep in mind that gerrymandering can absolutely backfire. It dilutes strongly held districts to create a greater number of weaker-but-favored districts. A significant boost in voter turnout is all it takes to steal MORE seats than previously thought possible.
37

> The U.S. Supreme Court on Monday set the stage for Alabama to eliminate one of two largely Black congressional districts before this year’s midterm elections, creating an opening for Republicans to gain an additional U.S. House seat in a partisan battle for control of the closely divided chamber. When Democrats change the map, they do it after the public votes and approves it. When Republicans change the map, they just ram it up your ass without permission. Tell me again how both sides are the same?

And while you’re studying that reality — judiciously, as you will — we’ll act again, creating other new realities, which you can study too, and that’s how things will sort out. We’re history’s actors . . . and you, all of you, will be left to just study what we do.”

Just rolling over when seizing messaging would be *so f****** easy.* Both sides are not the same, one side is the clear "evil" side, but those in charge of the other side are useless dumbfucks and need to be ousted just as badly as Republicans if we can ever hope to have a functioning country again.

Roberts and the Gang of Six really want to make sure Black votes are so diluted they really won't count any more.  This is how you steal elections.
172
FILTHBOT4000 5 hr ago +7
Not just that. Roberts apparently wants to be the supreme power in the land. I mean they just up and decided that a well established law shouldn't exist the way it has for decades. They didn't say it was unconstitutional; just nullified a congressionally passed and President signed law. That's not their job. But when the Executive and Congress are about as honorable as an Ophrah Winfrey guest, all bets are off. And apparently only he and the rest of the Six Shits can divine what the Constitution means, and no one else, not past courts, nothing else.
7
JerryDipotosBurner 8 hr ago +66
> Anticipating a court reversal, Alabama officials recently enacted a law allowing it to void the results of a May 19 primary for some congressional districts and instead hold a new primary under the revised district boundaries. More specifically, he'll be remembered as leading the most nakedly partisan, corrupt and politically motivated court of all time - unless his successors are allowed to dig even farther towards hell.
142
DingerSinger2016 9 hr ago +37
No, that distinction still goes to Roger Brooke Taney for the 7-2 *Dred Scott v. Sandford* decision.
37
JebryathHS 8 hr ago +54
In terms of known impact, absolutely the w***** for awful. In terms of nakedly political, I'd say roughly tied with 6-3 stating that the president is above the law (but only if the court concedes that his actions were official). Trump vs USA has got to be one of the worst rulings of all time. As pointed out *in the dissents*, it implies that it's legal for the president to order the military to *arrest or murder political rivals*. This not only obviously flies in the face of the Construction and established law and precedent, it also represents everything the Founding Fathers hated and tried to avoid while writing the Constitution. But it's not even just that! It actually then goes on to overturn an additional two hundred years of *English* precedent by effectively making the President a unitary executive with power similar to kings before the magna carta. (Then, hilariously, continuing to rule against Biden on a number of issues because they knew he wasn't a monster that would have them arrested and killed as they had argued he could.)
54
bros402 6 hr ago +9
Yeah. Roberts definitely did put his entry on Top Five Worst SCOTUS rulings, though. Dred Scot v. Sanford Plessy v. Ferguson Buck v. Bell Korematsu v. US Trump v. USA I think Trump v. US knocks Lochner off of the worst rulings list

196
Indigoh 9 hr ago +73
The only way to be sure they still matter is for all of us to vote. Look at it this way: * If we don't vote, they don't have to jump through any hoops to get the results they want. They just get it for free. * If we do vote, and they dislike the results, they have to *work* to change them, opening themselves to mistakes and draining resources. If our elections are already vulnerable to illegal manipulation, and you want to fix that vulnerability, voting is the first and most important step.
73
QitianDasheng2666 9 hr ago +90
We're going to have to do more than vote and I don't mean spend a Saturday holding a sign. They're not going to accept the results and we will have to put our bodies on the line to defend our rights. Anyone who isn't preparing for that now should just make peace with living under authoritarianism, because these are our options.

151
sillyhillsofnz 7 hr ago +21
It's difficult to be merciful *and* just. After winning the Civil War, the Union, for whatever reasons Lincoln, Grant, and Co. had, decided to be merciful - something the Confederacy never would have been to a defeated Union; if you don't believe me, just look at how they treated the dead Colonel Robert Gould Shaw. I understand mercy, especially for your fellow wayward countrymen. But mercy without justice leave those who were wronged and who may still be vulnerable wide open to future reprisals and backsliding. No accountability or punishment for those who did wrong leaves them a position to do it again. And wouldn't you know it - here we are.

Lincoln was merciful but he wasn't going to let the Confederacy get away with EVERYTHING like Johnson did, and Grant tried his best to tighten the ghost of a leash on the southern states that remained after Johnson got booted.

Can you imagine John Roberts will live forever as thr Supreme Court Justice that end the Constitution and especially the bill of rights as law of the US

There is no longer a functioning legal system in this country. F****** fascist MAGA whores have turn the US into lawless cluster f***.

F*** the supreme court. As a kid you read and hear about this supposed impartiality, and now the trust has completely eroded away. They said they are apolitical - what a load of shit. Expand the supreme court and put term limits and an impeachment process
65
GallowWho 8 hr ago +11
There was never impartiality when judges are referred to by their political affiliation.
11
floppy_disk_5 7 hr ago +5
better yet, require a 2/3rds majority rather than a simple majority to put a judge into the supreme court.

Virginia needs to gerrymander based on the SCOTUS ruling. Start lowering their D+17, D+18 x2 and D+26 to D +12 and move the excess to the R+3, R+6, R+12 and even Red districts.

I have said for a very long time that John Roberts is the new Roger Taney and that on the long arc of history will be seen as that. Taney’s Court, in the Dred Scott case, infamously found that black Americans were not citizens. Until now, it has largely been considered the worst case in American history. John Roberts would make Roger Taney proud.

"Those who make peaceful revolution impossible will make violent revolution inevitable" \- JFK The supreme court is playing with fire. They are courting a very dangerous turn of events. One thing that I keep coming back to is that at the end of trump's stupid coup attempt, everyone went home without much argument. It's like they all knew that the jig was up. Those tools knew that the election hadn't been stolen. If they truly believed that the will of the people had been subverted, they would have kept fighting. The fact that they left so easily speaks volumes. If gop shennanigans swing the election to steal power from the electorate, I don't think the anger in this nation will be soothed so calmly as on Jan. 6th. I really hope the gop comes to its senses and stops trying to blatantly cheat their way to an undeserved victory.

Trump said he would cheat in the 2024 election with Elon. Elon said he helped cheat. Every swing state was won by miracle razer thin margins. Not a single county in the *entire country* flipped from red to blue for Harris (this didn't even happen in Ragean's landslide - Mondale only won like 50 counties, but still some of those flipped from Ragean - and 2024 wasn't even close to a landslide) It's already clear that voting was tampered with in 2024. The results are statistically insanely improbable and the idiots f****** admitted it. Where is the uprising? If it didn't happen two years ago, it isn't going to happen.
54
ButtEatingContest 7 hr ago +24
> Trump said he would cheat in the 2024 election with Elon. Trump cheated by running at all. He's strictly forbidden by the constitution from running, but then the Supreme Court made up new special nonsensical rules making the constitution have no enforcement mechanism. (The Supreme Court could have simply over-ruled court findings that Trump as an insurrectionist, but instead they did this bullshit. Same bullshit that may open the door for a third Trump term)
24
E1M1_DOOM 9 hr ago +35
I've heard this before, but right now it's still very much only believed by the fringe. True or not, the accpetance of these details hasn't been enough to warrant an uprising. It says a lot that no serious politician is parroting these claims. Again, true or not, what you posted is not generally accepted as credible by the majority of the electorate.

Not only this, but the elections are already certified. The time to challenge that was (ironically) on January 6th, 2025. Instead it was ratified unanimously.

“And so I come full circle on this response and just want to encourage you with some substance that we are in the process of the second American Revolution, which will remain bloodless if the left allows it to be.” -Heritage Foundation President Kevin Roberts

The Supreme Court has lost all legitimacy as an arm of the Trump Party. The Constitution has become an antiquated piece of paper under Trump. Roberts will go down in history as the most useless Chief Justice as the country reverts back to anti-diverse "White Christians Only" and "God supports us" philosophy politically.

Careful, that sounds like a historic understanding and an acknowledgement that the courts shouldn't ignore the clearly written and well known intent of the still living people who wrote and ratified the fourteenth amendment and the voting rights act. We should all aspire to avoid being political actors, like Kavanaugh, who is so famously committed to neutrality that he worked on the Clinton investigation.

Sometimes they say it's too close to an election to use maps that aren't racially gerrymandered. Now its never too close to an election to eliminate the voting power of black people. So weird how racism is solved so we don't need these protections anymore and its not fair to make some states report to the federal goverment to have their maps approved for congressional seats yet as soon as those protections are stripped away the states that rebelled against their country immediately try to rig the maps in white man's favor.

It’s curious how partisan translates to racial. Evidently removing Democratic districts is the same as removing Black and largely minority districts. So while it’s legal to draw a map on partisan lines, it’s illegal to draw a map on racial lines. Funny how they arrive at the same outcome regarding district boundaries. So the only conclusion that can be reached is that the Republicans represent largely White voters and Democrats largely minority voters.

I hope everyone is ready for two more years of majority Republican control, a possible endless term for Trump, a MAGA Supreme Court for decades and possibly no Democrat in the Oval Ofrice for another decade. Just like with Project 2025 and everything Trump said in the lead up to 2024 what they promised is happening. They're setting up the guardrails for a smooth midterm and controlling majority power in a hypothetical "fair" 2028 Presidential election. And there is not a single thing the average American can do to prevent it from happening besides vote and pray your district isn't destroyed.

John Roberts single handedly destroying any integrity the Supreme Court had left. Regardless of what you think of it, the Supreme Court was truly a marvel. And most justices did hold respect for the institution regardless of their political opinion. Being able to dissent in a written essay and pass down rulings to lower courts in detail so they can then interpret the law when a case comes to their court. All tarnished by the abuse of the shadow docket. Most people believed the Supreme Court was the last pillar of our democracy. Good luck restoring that faith with the damage these christian fascists have done to it. May history forever remember them for their contribution to the demise of the court.
