We had to have this discussion recently at work as I am in Kansas. Basically, we do nothing. If someone complains we basically tell them we have our bathrooms labeled. If they make a scene, we just call the cops and let them deal with it. I don't think it will ever be an issue outside of things like this post.

As much as I hate this bigoted law and want to see it repealed, a law that can’t be enforced 100% of the time doesn’t mean it’s a bad law. Murder is illegal, but obviously there are unsolved murders out there, meaning it isn’t always “enforced”. Should murder be legal?

I think the difference is that you can enforce murder laws in ways that make sense. There is basically no way to enforce these bathroom laws that isn't insane and a violation of the 4th Amendment.

To this day I wish we just did away with gendered bathrooms entirely and just made a series of gender-neutral single-stalls, so that way the women's bathroom having one of eight stalls occupied can be opened up to me, who has to piss but the men's restroom has all 5 of its stalls occupied and I'm not shitting in the urinal. Yet.

Living out in the Bay area there's a few bars and restaurants that just have a main area with mirror and sinks for washing hands and the stalls are just made to be a bit more private than the standard ones and it's totally fine, nobody cares.

I’ve said it before and I’ll say it again, the Billings Montana has the best unintentionally trans-friendly bathrooms I’ve seen in a long time - it’s just a bunch of individual cinderblock walled rooms with a toilet and sink and a lock on the door. And while there are sections that are designated for male or female, they’re all clustered together in the same space. Too bad I don’t plan on willingly setting foot in that city again if I don’t have to.

It’s not about bathrooms, it’s about criminalizing trans people existing in public. They know that these laws leave trans people in a catch-22 where you’ll get police called on you regardless of what bathroom you use based on whether or not any random person guesses you’re trans or not. You don’t pass you get police called on you in one bathroom; you do pass, you get police called on you in another. Which it is on any given day can be dependent on a variety of arbitrary factors such as how much effort you put into your outfit on a given morning, how much attention a given observer is paying, and an observer’s familiarity and stereotypes about how trans people look. Cis people don’t usually clock trans men, even when they explicitly tell them that they’re trans. This means they are either constantly breaking the law or facing the obvious risk of getting cops called on them when women see a buff bearded dude in the women’s room.
