I doubt he legally has that authority, but does that even matter anymore?

he doesn't have the constitutional authority to re-appropriate funds as he sees fit.
but doing illegal things has never stopped this administration since it came in.
they put the onus on us to stop them with lawsuits. that's the roy cohn playbook

There was always the ability to pay them. His hand has been forced so he is solving a problem he himself caused. His EO means nothing. Classic Trump.

They won't get paid. This is smoke and mirrors and when they don't get paid of get paid a tiny amount the Republicans and him will just blame the crooked courts and Dems for stopping their checks.

DHS has a huge budget and could have paid them, yes. But Trump needs to always be the hero of the story and he wanted people to blame Democrats.

And only the most diehard cultists of MAGA are blaming Democrats. He lost any leverage he might have had when other Republicans said Trump told them no.

Exactly how is he going to do this? I suppose the only legal way is they just take from the very large DHS funding, meant for ICE, and re-appropriate it for the TSA. Since it's within the same agency, and is the same agency funding this might be legal?
But it also begs the question what Republicans are planning to do next. You know they spent all that effort appropriating billions for ICE, and they want it to be "fully funded". Which means they must have some plan to get money to refill those coffers later. I don't think there's any way they just roll over and allow Dems to have a victory on using ICE funds for the TSA.

My question is whether it’s just for the front line agents or all employees of TSA. There are other people working who don’t do screening.

So he had the power all along to do this and didn’t? Just because he wanted Democrats to take the blame. God help us. Republicans are snakes and Trump is a vile human being.
13
CaptMal065Mar 27, 2026
+8
No, what the article didn’t go into is that he doesn’t have this power. No money has been appropriated by Congress, so no money can be spent by DHS. The exception is the billions that was appropriated to ICE.
Now, IANAL, so I don’t know if they can use the money for ICE to pay TSA temporarily or not. But if they could, they should have started doing so before the first missed paycheck.

The airports with the most ICE agents quickly become the most chaotic and dangerous places to be. And it’s usually Red States that get the worst of it.

This is a tough one for me to form an opinion on. On one hand those people NEED to be paid asap, but on the other it creates a pretty bad precedent if the president can just override funding through an EO. I hope the government doesn’t try to reclaim those funds when it’s inevitably found to be illegal, that’d be fucked.

If Dems fight this, they’ll be playing right into Trump’s hands. “Dems are stoping TSA workers from getting paid!” on all conservative outlets. Let Trump have this “win.” TSA workers NEED to be paid.
2
etang77Mar 27, 2026

That's why Dems loses if they do what you say. Conservatives will either be Dems are stopping this or Trump won this. It doesn't make a difference, where as Dems will see them continue to fight worth supporting more than losing to Conservatives again.

The Democrats were getting close to forcing the Exective Branch to pay the TSA, that's the emergency that Trump is responding to because he doesn't care about whether the TSA agents can't feed their families, he cares that the Democrats don't get credit for fixing the problem.
