A federal judge on Tuesday ordered the University of Pennsylvania to comply with a subpoena from the EEOC seeking a list of members of its Jewish community in what the federal government says is an effort to combat antisemitism on the Ivy League campus.

They’re probably trying to do what they did at Cornell. Collected a bunch of contact info and then emailed a subset of them a ridiculous survey to ask about harassment and bias they’d experienced on campus. They’re basically trying to collect “evidence” on campus antisemitism by directly contacting people who are…likely to self-report a bunch of nonsense.

This has nothing to do with Palestine, zionism or anything else. Edit: for the record I think the lost is abhorrent, dangerous and there is no justification for it. Student and staff should be encouraged to file reports rather than compiling a freaking list.

They should speak up, which is why it should just be a hotline for people to proactively report what they are facing instead of a blanket identification of personal information. Don't be obtuse...the motivations of this particular administration are obvious, and they're trying to contact as many people as they can to find "proof" of the narrative they've already established. They aren't actually trying to stop antisemitism.

A nationwide Jew list? Do they want to know who is ethnically Jewish, with genetics to back up the claim? Do they want a list of people who are practicing religious Jews? If they want the list sorted by ethnicity, then they need to require a genetic test for all students and staff to determine their percentage of Jewish ancestry. This will also produce many false positives, but they will still probably need to be listed for eugenics purposes. I am guessing the people who want this list probably actually believe that eugenics is a valid science--Stormfront types, for example. Stormfront and MAGA have a great deal of burning crossover.

If they wanted to ID those who committed acts of antisemitism, one would think that they would put out a memo encouraging those who know anyone who is antisemitic or who has committed an act of antisemitism to report them rather than asking for the names and addresses of Jewish people associated with the University. All you would get would be some of the stories of Jewish students who experienced antisemitism but it wouldn't tell you who was doing this unless these student knew who were responsible for the incident and were willing to name them if they knew who they were.

The whole "demographic" portion of applications for everything from loans, to student aid, to jobs, to welfare has always been a method to collect information to discriminate against marginalized groups anyway. A pertinent recent example is redlining, which we have documented evidence of having occurred as recently as 2020, and anyone who looks at that year and thinks it isn't still going on is fooling themselves. The way it's conducted though, identifying as anything other than White just means you get treated as non-White.  And of course identifying as White if you're not "White enough" is fraud. The exceptionally stupid thing is that some people groups indigenous to the United States are required to document their "blood quantum"(which by the way is only done with these people, horses, and dogs), and must be at least 25% native to qualify as "Native".  But being 75% White apparently still doesn't qualify them to select "White" on the forms. https://www.justice.gov/opa/pr/justice-department-secures-over-31-million-city-national-bank-address-lending-discrimination

I dont have knowledge of this type of issue so Im hoping someone who has worked on these types of cases chimes in, but this seems incredibly out of the ordinary. Their claim is that they need the list of students and faculty who may have witnessed antisemitism on campus. Is it normal to cold-call all of the people of another ethnicity at an organization as part of a civil rights investigation, or would they set up a tipline? Wouldn't the investigation start after there was reported discrimination, rather than fishing for it? What is the purpose of having their addresses and specific organizations they belong to if not to weed out ideologically opposed Jewish people?

It's certainly not a good look, nor a good precedent to be asking institutions for a list of their Jewish members (or members of any specific background), even if the purpose is to run a survey on antisemitism within the org. This subpoena getting confirmed is ridiculous. But no, the real antisemitism, at least the stuff we're worried about, is indeed the people who physically attack Jews because they're Jewish.

This was a single judge ruling. It will definitely be appealed. Most likely they will ask for a panel to look at it. The panel does not review and reverse the decision, they will go to an appeals court. And after that, the Supreme Court. In the meantime, it might become a sprawling, complex case with lots of interested parties and amicus curiae and all that fun stuff. A case like this can really grow some legs. Or nothing might happen. They might just accept the ruling. Just depends on how much they want to fight this.

Highly unlikely UPenn can comply because they have no reason to obtain/store that data in the first place. At most, they could provide a list of people that lodged complaints based on their Jewish religion/heritage, but that would be so far from a complete list it makes the original request even more absurd. When was the last time you saw “religious affiliation” on a job application or new hire orientation forms? Just seeking that information would open UPenn up to so many lawsuits.

This is a great case study for the phrase, "The road to hell is paved with good intentions." Ostensibly, the goal of the EEOC is to fight anti-semitism(which is fine).  But this subpoena is absolutely not good, and the University is correct to refuse to provide the requested information. They've correctly stated they do not maintain a list of individuals with religious affiliation, but even if they did, this is not something you'd want to provide to an external entity for any reason. The University's only morally correct course of action is to ignore this judicial order.  I don't know if that means someone will get arrested, or the University fined, or what.  Hopefully, everyone at the University is on the same page here though. The EEOC needs to find another way to accomplish their stated goal.  This isn't right.

We all know Trump's admin doesn't actually care about antisemitism. We all know they are only going to use this information to attack universities and wage more corrupt lawfare. We all know this won't improve anything. The problem here is the EEOC does have a legitimate role in taking on discrimination, like antisemitism, so there is some validity to the general idea of them making a request like this. They'll do something nefarious and probably illegal with the info and then people can sue them at that point.

The Trump administration strongly supports the country of Israel but is simultaneously compiling lists of Jewish Americans. Meanwhile if you criticize Israel and do nothing negative whatsoever to your Jewish colleagues and neighbors, you’re supposedly antisemitic.

This the EEOC doesn't push to hire more of anyone. They investigate complaints and policies from existing issues. But yeah, I'm not enjoying the Trump world's version of equity.
