US agents arrest tourist after video shows a rock hurled at endangered Hawaii monk seal’s head | CNN
A tourist who drew widespread condemnation in Hawaii after a witness recorded him chucking a coconut-sized rock at “Lani,” a beloved, endangered Hawaiian monk seal off a Maui beach, was arrested Wednesday by federal agents.

Are states not allowed to ban people? Is it just a federal level travel ban? He’s American so he gets to go to any state?

States can not ban people. Yes, any American can freely travel between states.
438
RogerianBrowsing 1 day ago +336
States can put out warrants or APBs that don’t get enforced by other states. So you’re right, they can’t actually ban Americans from traveling between states but they can sure make life insufferable for anyone who insists on returning.
336
gfy88 1 day ago +55
They aren't enforced by other states but they are definitely still in the system and they are extradited to the correct state if arrested. Most of the time.
55
juicius 1 day ago +108
Actually, you can effectively banish him from a state, except for one county, as a condition of probation. It's Constitutionally and in practice kind of questionable but for Hawaii, it may be more enforceable than the mainland states because it's a collection islands way way out in the Pacific. The banishment has some exceptions, such as transit and emergency exception, but as far as in Georgia, it's been upheld.

Huh. Great loophole. You’re not banned from the state, but the only part of the state you’re allowed to visit is accessible only by a mule trail. That’s pretty much banished hahaha
117
MultiGeometry 1 day ago +23
This may lead to the rise of ‘banishment counties’ where states set aside some land that’s largely inaccessible by air or water just so they can ban people.

Fun fact, people get exiled from villages in Alaska on occasion. The legal basis for this is because many federally recognized tribes in AK are on the village level. So it’s an aspect of tribal law.

I don't think he expected more than a local fine, like a police ticket/citation. Endangered animal stuff tends to rightfully blow up, though. Hope they throw the entire book at him as an example to other rich douches who think they are above the law. The maximum penalty here is 1 year in federal prison and a $50k fine. I hope he gets the prison time so the lesson has a small chance of sticking. Edit: Could also be state charges with a max of 5 years in prison. Afaik you can get both, so he could end up with a max of 6 years between 2 diff prisons and the fine.
123
juniorone 1 day ago +96
I don’t want federal charges. I want state charges. I heard that there is a guy living in the White House that loves when people get federal charges. He pardons them for a fee.
96
wolfgang784 1 day ago +26
After searching it a 2nd time, he could be charged with both. Hawaii in particular does up to 5 years in prison for actions like his. Afaik you can be sentenced for both state and federal crimes at the same time and he would spend jail time in either state or federal first and then go to the other and serve time in a different jail. So that could happen. Dunno whats likely, but its possible.
26
Expensive_Track_8822 1 day ago +27
that fee is way out of reach for some dude who lives in a tract home in covington wa and still has to work for a living. he has “go on vacation to hawaii” money, not “buy a presidential pardon” money. this guy is affluent, not rich. maybe affluent should be past tense: criminal defense can bankrupt people.

We have signs all over the place where wildlife like these seals hang out basically begging people not to harass the wildlife, very specifically asking them not to hit or attack the seals or do shit like try to ride sea turtles. We also have big signs and neon flags telling people not to swim in jellyfish infested waters during jellyfish seasons. Every year people do it anyway.

Yeah, I’m “Team Bison” too. I watched this happen two years ago on a trip there. Some muppet got out of their car, walked right up to one grazing along the road and tried standing right next to it while his wife took a picture. The rest of us then watched as the Bison gored and stomped on him before running away. Some folks dragged him back to his car and his wife speed-ran it back to the lodge. I heard the next day from a park ranger he was expected to live, but damn is he going to be carrying those stupidity-scars for the rest of his life.

It was more of a factual book and not so much a comedy but we had fun with it regardless. They categorized a lot of the deaths into chapters and told some specific stories in each chapter mixed in with some quicker anecdotes and summaries of multiple deaths that were all similar. They go into detail about people losing children after placing them on bears for photos or antagonizing the bison until they get gored

Same in Banff and Jasper, close to where we live. It used to be the policy that the animal would be destroyed after an incident where a human got injured. That is no longer the case. We now relocated the animal deeper within the park and fine the ever loving f*** out of the idiot. Personally, I would prefer the fines to be a percentage of their net worth. Then it would slow down the idiot.

I saw this happen once in person years ago, and I’m not condoning violence or celebrating someone getting hurt, but it was glorious. It was on the Old Faithful boardwalk and I watched a lady casually walk up to a bison like she knew it and they were old friends. It head butted her so hard she rolled away in to the bushes like a tumbleweed. She got up so I assume she was ok but I haven’t laughed that hard in a long time.

I ran into a Ranger in Yellowstone while I was pulled over on a road to watch a few Grizzlys off across a field. The ranger told me that the week before they had to intervene when they came upon a couple who had smeared ice cream on their toddlers face and were ushering the child towards a bear, because they thought it would be cute to get a picture of it licking the toddlers face.

Because a fine only tells people how rich you need to be to flaunt the law with impunity. It's no deterrent once you're rich enough. But time is something of which we all have the same amount. You can't buy more of it. (not enough to matter, at least)

They said their *lawyers* wanted them to say they didn’t condone it. That’s not the same lol.

Not only beat up, but the guy that beat him up got an award from Maui county. He was named anonymously as an "environmental activist" so he couldn't face possible charges.

They made him an Ambassador of Aloha for protecting wildlife

I saw that clip. Wasn’t anything “about to” about it. [He was being pummeled](https://youtu.be/7tiL8hbKN9c). Edit: maybe not “pummeled,” but dude made his presence *very* known and made solid contact.

The way the attorney was not just smirking, but outright *grinning* when the Senator said that he was advised not to condone violence SENT ME.

Yeah I stopped by to say that. That was sweet to see. And I liked the way he phrased it when he said, this is what can happen if you mess with our land, and the animals on it.

Apparently he also put his hands on a woman after throwing the rock so he double earned that beatdown. “I’m rich.” Well, money ain’t gonna buy your way out of catching those hands. F*** that guy.

Yea they did a press conference where a lawmaker called them “environmental activists” and said they legally don’t condone violence but that’s what happens if you mess with their land.

I'm sure there would be a line of people waiting around the island to throw a rock at this chud's head.

"If convicted, Lytvynchuk, faces up to one year in prison for each charge. He also faces a fine of up to $50,000 under the Endangered Species Act and a fine of up to $20,000 under the Marine Mammal Protection Act." Can we make all fines scaled against someone's net worth or income pretty please

I love a happy ending. The outcome of this guy throwing the rock and gloating that he was rich: 1) Got his shit kicked in by a local with the altercation being recorded and posted to social media and the shit kicker got an anonymous award and is not being charged. 2) Was doxed and has his face, name and other info all over the web. 3) Is having his logistics company review bombed and trolled. 4) Was arrested and is now facing serious charges.

Imagine seeing a beautiful wild animal, a moment to savor and appreciate for its majesty and wonder, and thinking, "I'm gonna throw a rock at it." Wealth culture, summed up nicely.

>When a witness confronted the man, he said “he did not care and was ‘rich’ enough to pay any fines,” the complaint said. Give him some jail time and he'll definitely care. Each charge carries up to a year of jail time.

Hawaii has been dealing with stupid f****** tourists violating their land and ecosystem ever since is was annexed, they must be way way past done with shit like this, so it is not surprising that this guy got beat up. I distinctly remember so many of their beaches being crowded by tourists that locals who grew up surfing there had to close off some small beaches just for locals by blocking roads to them.... and still tourists came.... and then got the aloha invitation to leave

Some locals 'helped' him see the error of his ways before he was arrested, too. I was in the Seafarers International Union for a few years. One thing I learned from my shipmates is that I WILL learn *aloha* spirit if I act up. Both Hawaiians and Residents will be happy to teach me.

If he doesn't have citizenship status, then the end result of this should him being deported and banned from re-entry I feel like that is how all countries should handle crappy tourists. You force them to leave and ban them from ever coming back

In ohau a few years back we saw a momma seal with babies on the beach. Not far away were two guys in uniform with automatics. The resteraunt dudes told us they were wildlife officials there to protect this endangered seal. They also said the night before a tourist approached the seals for a selfie and ended up in handcuffs.

Former resident of Hawaii here -- this guy is lucky he didn't get disappeared. The people of Hawaii are some of the most loving and friendly people in the world, but they take their connection to the aina/land very seriously. Conservation is much less political in Hawaii than any other state I'm aware of, because being in that island environment makes awareness of the beauty but fragility of nature an everyday thought. Had a bunch of huge Polynesian guys been audience to this act Im not sure what would have happened to him.
