Virginia state legislature should just say: "We have the constitutional power here, not the court." If Ohio can do it, so can Virginia. https://www.brennancenter.org/our-work/research-reports/timeline-ohios-gerrymandered-maps-how-ohio-politicians-defied-court

Unfortunately that only works for Republicans. Democrats HAVE to follow the rules for some reason.

Democrats need to stop doing the two sides thing. I keep hearing "yeah Joe Biden did that and it was bad, but".... STOP! Stop doing this two sides thing and defending what republicans said about you. Literally only attack. Don't waste time defending, it's ammo for republicans.

It's Murc's Law. The idea that only Democrats have agency for their actions because it's just assumed that Republicans will always do the sinister thing and so nobody even bothers trying to pass judgement on it. When Democrats do something good it's,"Well why didn't they do something better?" And then when Republicans do something bad it's, "Why aren't the Democrats fighting this harder?" It's why something like the War Powers Act vote recently gets 1 or 2 Democrats who voted for it and they catch all the ire because it's just taken as fact that it's not worth examining the persuasions or positions of the entire half the Senate that voted along party lines.

That's why the midterms aren't even a hope. We've already got a mountain of evidence that a Democrat majority *still* weighs every decision against, "But that'll make the Republicans angry!" and the Republicans *still* employ every stall tactic in the books. The Republicans are winning because, whether you like their policies or not, they are willing to fight to the death to achieve them. Very few Democrats stand so firmly on progressive issues. I think this has a lot to do with why GOP voters are so fired up and consistent and you can't motivate other voters to show up, it feels like our only two competing choices are: * "I like slavery and think it should be legal. Vote for me and I'll push to reestablish it." * "I don't like slavery, but I hate conflict even more. If you like slavery, why don't we have a round table and I'll listen to your views and perhaps we'll come up with a way where I get elected, I can say I don't like slavery, but I also help you reestablish slavery and get called a progressive." There's really only one political group that seems excited about their own policies. That excitement is contagious.

I think the difference is the VA legislature simple doesn’t have the power to draw a map at all? Correct me if I am wrong

The Ohio Constitution also requires a redistricting commission and literally has this provision: "No general assembly district plan shall be drawn primarily to favor or disfavor a political party."

Ya but I think the difference is Ohio legislature can draw maps, just not bad maps but VA legislature can’t draw maps at all.

They can only draw maps with bipartisan support.  Otherwise the redistricting commission takes over.

Florida went against their own constitution to gerrymander their seats. It's insane to expect that Democrats should follow the rules when Republicans act in flagrant violation of the law.

In TN they simply called a special session, repealed the law banning redistricting so close to an election, and passed a new map which will deliver a 9-0 R majority. It’s a great example of chess with a pigeon.

Fellow Tennessean here. Same, but I'm not surprised. It's funny how the government "can't do anything right" and "moves too slow with too much red tape" until Republicans' power structure is threatened. Then suddenly it's the easiest thing in the world. Gee, I wonder why that is?

Meanwhile Dems in states they control are sitting on their hands. That they aren't acting RIGHT NOW is damning. edit: I should say I do not like this state of affairs at all. I think that this arms race towards nationwide gerrymandering is the death of democracy. But at the same time Democrats were not put into this situation by choice. They must fight fire with fire or face certain defeat.
1337
mosesoperandi 3 days ago +380
Except they aren't. The whole point of this article is that Virginia Dems acted, but based on state law there was a procedural piece that Republicans were able to use to catch this up and have it overturned by the Virginia Supreme Court. This type of discourse really feels like it's playing into a helplessness narrative that is entirely counter productive, especially when it's inaccurate. Edit: Someone called out that I incorrectly used the term counterfactual. Edited the end of the last sentence to inaccurate instead.

its laughably pathetic that Florida's constitution can't stop republicans. but a virgina law can... We live in the timeline where laws and constitution doesn't mean shit right now.
176
mosesoperandi 2 days ago +66
It's deeply problematic. Should the Democrats just start breaking their own state laws? That has the potential to roll a case up to the corrupt SCOTUS which will certainly find for the Republicans, and then you have the potential for state Dems to face criminal trial that the Republicans will either pursue in Federal courts or try to have shifted to them. All three branches of government are captured by these authoritarians. The hope is that we saw an authoritarian seizure of a democracy just get defeated in Hungary. It is definitely possible to remove these corrupt fascistic fucks from power.
66
PostIronicPosadist 2 days ago +70
> Should the Democrats just start breaking their own state laws? Yes, Democrats should ignore a blatantly partisan and corrupt court. The rule of law has already collapsed, going along with it anyways is just going to ensure we have a fascist government for generations.

Yeah, I used ro feel this way. If dems break the rules it will be madness. But SCOTUS overturning Roe v Wade, making "official acts of the president" above the law, and the killing of the Voting Rights Act, it just shows that the GOP doesn't give a f***. Get dirty, fight fire with fire, show them what it looks like.
27
thegreat_hambino 2 days ago +17
If it went in the Republicans favor, couldn’t a Democrat FL rep (or any other state where it’s relevant) use that as case law against any shadiness Republicans are pulling?
17
mosesoperandi 2 days ago +25
SCOTUS has 100% shown that they're corrupt political actors. There is no reason to assume they will apply the law evenly. Meanwhile, Trump has the DOj and can turn it into criminal cases against the Dems. Working the edges and dropping decorum are necessary, but breaking the law won't advance the cause of righting the shop of state.
25
KnightOfLongview 2 days ago +80
As a virginian, I gotta say, I feel like the dems are pretty damned helpless. The right is fighting dirty, you can't just watch the country get destroyed, you have to go blow for blow. There is no referee coming to save them. They must save themselves and right now they are failing.

Republicans ignore state laws and force through gerrymandering anyway. If Democrats refuse to do the same, the country is lost. Regain power first, then follow laws again.

We are literally on a post about them trying something. I was hoping the Virginia thing could at least partially counteract the bullshit happening here in Tennessee. Republicans can’t win on their own so they have to cheat to do it. As someone living in Memphis, my vote literally no longer counts. I’m absolutely enraged. I just hope my Republican former friends are happy losing their own rights when their cheating party does everything they promised.

Never forget about Garland's nomination. He was nominated on March 16 of an election year and so, many republicans just made up rules about how you can't vote in a supreme court justice in an election year (which is absolutely not true at all). lindsay graham even went so far as to say "I want you to use my words against me. If there's a Republican president in 2016 and a vacancy occurs in the last year of the first term, you can say Lindsey Graham said, 'Let's let the next president, whoever it might be, make that nomination,' and you could use my words against me and you'd be absolutely right." So naturally, on September 29, 2020 (an election year) the republicans nominate a supreme court justice, and then confirm her *27 days later* on October 26. Which makes it the 4th fastest confirmation of the last 50 years. So not only did republicans break their own rules about 'you can't nominate a justice during an election year' but they did it in near record time, then claimed that it didn't matter and democrats are just mad they lost.

The political machine was ready to go, hoping for this result. I don't think the right would have gained this much ground the last 20 years if they hadn't been so well prepared to take advantage of systemic weaknesses of the legal system.

In this case Virginia SCOTUS said it’s unconstitutional because it was down through a special session. The goalposts are all over the place.
393
The_Lucky_7 3 days ago +342
The Virginia constitution doesn't say they can't do it either. It just doesn't explicitly say they can. Their state supreme court is just trying to pick the w***** of the election with this one. Which is super not their f****** job.
342
8bit_heart 3 days ago +113
And in Missouri our constitution says we can only redistrict after a census, but our state Supreme Court came back and said well it doesn’t say they can’t redistrict at other times!  Although it was obviously the intent of the law.  And this was after state voters approved a bipartisan board to set the districts and our government just said nah voters were too confused so it doesn’t count.

it is always incredibly impressive how rapid and laser-focused, and masterful at bureaucratic mechanics, the republicans are when they have the opportunity to disenfranchise and/or generally f*** people. Trying to do something to help people will take years of going back and forth and things being trapped in committee hearings and then after a minor miracle and years of effort, once they do move forward, they get shut down instantly by one of countless bullshit tricks, so in the end, years pass and nothing gets done. But if the republicans need to destroy something, they can get it done in seconds.
68
capnpetch 3 days ago +93
Can’t in this case. The law in question is a constitutional amendment that sets how redistricting gets done. They took issue with the process of amending the amendment, as the legislature basically called a very late special session last year in the middle of an election. Courts reasoning is that it was so late it didn’t give voters who voted early a chance to punish the legislatures (if they chose). With that said, court conveniently ignores that the voters approved the new amendment in a separate special election.
93
derpicorn69 3 days ago +44
Law says "election" which explicitly means the single day of final voting based on every legal definition in state and national contexts. The Republicans lied to day that the early voting period matters with regards to their reason

The solution should be that it is enforced anyway, and to arrest those who didn't comply with court orders in time. That would stop this bullshit instantly.

DenimDangerAAC 3 days ago +184
When the Secretary of State who runs the elections is in on it, how do we enforce what we voted on and the courts are ordering to change? We are seeing the people’s means of influencing what is supposed to be our representative democracy being diluted every single day. We’re running out of “legal” options for our voices to be heard. By all means keep voting and protesting, but these methods are losing their efficacy every single day.

What always gets left out of that story is that her server was MORE SECURE than the official gov servers. The government doc servers got hacked by Russia while she was serving, but they were never able to crack hers. I'm not saying what she did was secure or acceptable. But the point stands that her files were more secure than if she had left them solely on the State Department systems. Also - THE TRUMP ADMIN USES UNENCRYPTED MOBILE DEVICES, DISCUSSING TOP SECRET INFORMATION IN GROUP CHATS WITH JOURNALISTS.

Redistrict and make it even more in favor of Democrats then wait for that to get shot down. Then redistrict and make it somewhere in the middle of the current one and the very favorable one. Wait for that to get shot down. By then it will be close to election time and "oh, sorry, guess we are going to have to use this one." 🤷

That's literally what Republicans in Ohio have done for the last 5 years. The Ohio Supreme Court has struck down the "new" district maps 6 or 7 times since 2021, but the courts can't legally draw fair maps themselves, they can only order the maps to be re-drawn. The Republican-controlled map making committee just keeps pumping out different, but equally-illegal maps which get tied up in court until it's time for the next election and they get to use the initial illegal maps by default.

The problem is Democratic states built systems to protect democracy. If we were playing by the same set of rules, sure. But we’re not. The state constitutions and rules democratic states responsibly put in to protect democracy are now the thing that is actually allowing democracy to be destroyed by Republican states.

Pretty sure it was Russ Vought, one of the main drivers of Project 2025, that claimed we were already in the midst of the second American civil war and it would remain bloodless only as long as "the left" allowed it to be. I don't begrudge anyone that claimed they didn't know how they would manage to disrupt the elections because those were probably the biggest questions of this whole project, but anyone that thought they wouldn't be able to interfere because of the law or constitution or individual states etc were simply not paying attention. Facists make progress by always swinging and not even stopping for a second on any miss, just plowing forward all the same.

A convicted felon that couldn’t get employment at a fast food restaurant, can be elected president. Make it make sense. This is where republicans have been steering the country since Reagan. They got their useful idiot to pave the way. It just shows how fragile our democracy really is/was.

But remember that when asked Republicans will 100% tell you it's because Democrats cheated and were doing this first. They can't prove it but they'll yell and scream until you stop talking about it.

Republicans greatest talent is convincing people that democrats are evil and then literally doing what they say the democrats are doing. Yet the average joe never sees it that way.

Virginia passed an amendment in 2020 handing that power over to an independent bipartisan commission, so they have that authority, hence why this had to be passed as an amendment

> striking down a voter-approved constitutional amendment based on a narrow definition of the timeframe when the first stage of the approval process took place I don't think it's a narrow definition. It's a ridiculously broad definition that the VA SC just made up. The election is on election day. I mean seriously, if early voting hadn't started they'd be arguing that the primaries had already happened, so that counts as the election being underway so it doesn't count. It's calvinball all the way down.

Billionaires officially take over They know exactly what they're doing
170
Theguywhodoes18 3 days ago +53
Billionaires won’t have anything to run within a year of them taking over. The nation will collapse because you cannot build a society that is more interested in building wealth than building society, and they’ll flee to another country to focus their efforts of extracting as much wealth as possible until there’s no one left to steal from. But that’s only if they’re allowed to. FDR’s hand was forced during the Great Depression because Socialists were moments away from organizing a coup, and The New Deal was the only thing that stopped it. Billionaires will happily pay their fair share if it means they get to put off The Revolution.
53
StevieMJH 3 days ago +35
Today's billionaires are too far removed from those lessons apparently. They need the fear of the masses put back into them.
35
LivingCustomer9729 2 days ago +10
But it’s a little harder to put that fear back when half of the masses are gleefully ignorant and willingly to help the billionaires stay on top bc sooner or later “the wealth will trickle down to them”

Looking at the US as someone who is not from there, I'm pretty sure democracy is already dead in the US. even if the Republicans somehow managed to lose with all the cheating they don't intend to give up power. I'm sure they'll just ignore the results or then just flat out prevent another election. Your country is only a few pages away from a totalitarian government with a one party government just like Russia and China.

Why are we talking about democrats "midterm hopes"? I mean, GOP regime has been a complete clusterfuck. Surely they should be getting crushed in the midterms in any case? If the result is in any way in doubt, it just goes to show that USA is truly lost. But this might not be enough for Democrats to win". WTF people?!

I wonder how many Americans realize that most civilized nations on Earth use proportional or mixed-member representation for their national parliaments, so the entire concept of "I can redraw some map to make my party stronger" is completely incomprehensible to them. Meanwhile here is the US with it's f****** Stone Age version of "democracy" inventing more and more ways how a minority can overrule the majority will with ever more ridiculous ratfucking techniques, and everyone else is just staring at it totally baffled like "wtf they doin' over there?". I mean, Turkey just puts the opposition leader in jail when he has too much of a chance to win, so that's still marginally worse I guess. But only marginally.
